Rifle River Lodge LLC Rental Agreement - OCCUPANCY AND ACCEPTANCE OF PREMISES
By renting the Rifle River Lodge (RRL) you agree to the following terms and conditions: OCCUPANCY AND ACCEPTANCE OF PREMISES.
RESERVATIONS. It is understood and agreed by the parties, that any reservation obtained under false pretenses will be grounds for immediate eviction and all advance payments will be forfeited.
GUEST VERIFICATION. By renting RRL, Tenant grants permission to Safely Stay, Inc., to verify my identity and check criminal databases in order to confirm my reservation. Quests are required to text a two sided photo of responsible party's driver's license at the time of booking and rental deposit.
USE OF PREMISES. By entering into and occupying the demised premises, Tenant shall be deemed to acknowledge the demised premises are in good repair and order and that all appliances are working at the time of occupancy. It is understood and agreed by the Parties, that the Tenant shall use the demised premises for the purpose of short term (less than 28 days) vacationing only. Landlord does not rent to vacationing students or singles under the age of twenty-five (25), unless they are supervised at all times by an adult or guardian or parent. Tenant agrees there will be no vacationing students or singles under the age of twenty-five (25) in the premises, unless they are so supervised. Violation of such paragraphs would terminate the tenancy at the time of knowledge, forfeiting any and all security deposit and still require the Tenant to pay for the full term of the occupancy, without recourse.
FIREWORKS & DISCHARGE OF FIREARMS. It is hereby understood and agreed by all parties that no fireworks may be set off at any time, in the premises or on the grounds. It is hereby further understood and agreed by all parties that the use and or discharge of firearms of any type, excluding air powered, is prohibited.
FISHING & CREEK RELATED ACTIVITY. Fishing is allowed along the banks of Houghton Creek which is to the rear Rifle River Lodge property boundary. Trespassing is prohibited beyond the neighboring north and south posted property boundaries. It is understood and agreed upon that you fish at your own risk, and the Tenant(s) holds Rifle River Lodge LLC harmless for accidents or injuries related to fishing and or creek related activity. We encourage catch-and-release fishing practices in an effort to preserve our natural resource.
PROVISION FOR PETS: Dogs are allowed with Prior approval. Cats are not permitted. Please tell us about your dog(s). If you bring dogs you are 100% responsible for any damage they may cause. Should cleaning or repairs be needed due to damage or accidents from your dog, you will be billed for said cleaning or damage at cost of the cleaning or repair plus a $250 service fee. A $20 per night pet fee is due if you wish to bring your dog, which covers up to two dogs. This fee will be requested before check-in and must be paid before check-in. Dogs should never be left in the home unattended unless they are in a crate or kennel. Dogs are not allowed on the furniture or beds. You must pick up waste after your dog in the yard. This is NOT the owner’s responsibility. Excessive barking complaints from neighbors may be grounds for eviction of your dog from the unit. It is recommended that dogs should be on a leash when outside at all times. Rifle River Lodge is located in a rural wooded area inhabited by coyotes and bears as well as people. Dogs can easily run and become lost. RRL is not responsible for lost dogs.
INVISIBLE PET POLICY. The term “invisible pet” means that at checkout, we should not see any visible signs there was a dog in the rental unit. This includes, but is not limited to: pet hair, carpet and/or fabric stains, carpet and/or fabric tears, damage to furniture or flooring, pet food, or any smell or odor associated with an animal. Do NOT leave your pet unattended in the rental unit unless it is crated/kenneled. If you intend to be away from the renal unit at any time, you MUST put your pet in a crate/kennel or take it with you. Please keep your dog off the furniture and beds. Their nails can damage the upholstery and dog hair is hard to get out of upholstered furniture. Please pick up after your dog outside. If it poops in the lawn, please pick it up and dispose of it. Please make sure your dog stays on our property and is not bothering neighbors or barking. Multiple complaints about barking dogs by neighbors may be grounds for eviction of your dog from the rental unit.
STORM AND/OR FLOOD DAMAGE: Owners DO NOT issue refunds due to acts of nature such as: weather, road conditions, snow conditions, hurricanes, floods, power outages or forest fires unless the home is unusable due to a mandatory evacuation order by the local authorities or the National Weather Service.
SNOW REMOVAL. Owners have contractors scheduled to remove snow and generally they are very timely. Please be patient during large snowfalls as it may take them a while to get you your location.
EMERGENCY ACCESS. It is understood and agreed that the Owners shall have access to the premises at all times for emergency purposes. If it is a non-emergency, Owners shall be required to provide Tenant with notice, which may be verbal and/or written. Tenant agrees to not unreasonably withhold access to the premises.
CAMPERS AND TENTS. Campers are welcome at RRL with prior approval. Please tell us first about your campers. A $20.00 camper/tent fee per night for each camper for up to 5 campers charged. Camping is permitted only in conjunction with the rental of the lodge. It is understood and agreed that guests are not allowed to set up tents on the premises without permission. Our short-term rental licensing does not allow for the property to be used as a public campground. All tents must be set up in the yard behind the dwelling and not in the front or side yards visible from the road. Electric and water hook-ups are not available.
SEPTIC SYSTEM. Our wastewater goes into our own private septic system. This type of system is not nearly as flexible or forgiving as the public sewer you probably have at home. In our lodge, anything flushed down a toilet or through a water drainpipe goes to our septic tank where waste rots, the liquid is distributed into a mound infiltration system and sludge is pumped by a waste handler. For this system to function properly, it is important that guests do not put down a drain anything that will not rot or that might clog the system. Please do not put anything else down any drains or into any toilets other than waste matter and toilet paper. Specifically, do not flush any of the following: plastic bags, paper towels, wipes of ANY kind (even if the packaging states the wipes are flushable or safe for septic systems), feminine hygiene products or condoms, grease such as bacon fat or cooking oil (scrape grease into trash and then wipe out with paper towels before washing greasy pots and pans). If you allow anything other than human waste and toilet paper to enter the septic system, the tenant may bear the considerable expense of having our septic system pumped out after you leave.
OUTDOOR FIRES. This rental unit is equipped with an outdoor fire pit. Please only build small fires inside the fire pit, and every time the last person leaves the fire pit area, be very, very sure the fire is out. Please make sure the fire is extinguished with water when you leave the fire pit area. Never start a fire when it is windy! Please adhere to area fire bans when conditions are dry. Damage caused by fires left unattended is the sole responsibility of the tenant. RRL does NOT supply firewood or items to start the fires such as kindling. Please bring these items with you.
PROPERTY BOUNDARIES. RRL offers a sizable tract of land for your enjoyment. The property is posted, and tenants are not allowed to venture onto the neighboring property or the property east of Houghton Creek with the exception of the east side of the creek for fishing.
ATV and UTV. The use of all terrain and utility vehicles, including snowmobiles is not permitted for safety and liability purposes on the RRL property. Hundreds of miles of off road trails are accessible in the nearby Huron National Forest or the trail head located in Rose City.
SECURITY CAMERAS. It is understood and acknowledged that to ensure the safety of the tenants and owners, 6 (six) live feed outdoor security cameras are located around the RRL property exterior. There are no interior cameras on the RRL property. The general Lodge policy that the security system is disabled during guest stays.
ITEMS PROVIDED. Landlord shall provide all bedding, full kitchen accessories, fire pit. We supply rolls of toilet paper in the bathroom and paper towels in the kitchen along with hand soap, dishwasher soap (pods), liquid dish soap, and laundry soap (pods). If you should run out of stocked items, we do not restock. If you need to buy toilet paper please buy one ply tissue as we are on a septic system.
ITEMS NOT PROVIDED. The Tenant shall be responsible for providing the following, but not limited, items: food, beverages, bathroom soap and hair shampoo, extra laundry and dishwasher detergent, and fabric softener It is also understood that there is not a landline telephone at the premises, however there is cell phone coverage in the area.
CLEANING SERVICE. While bedding linens and towels are provided, daily maid service is not included in the rental rate. Unless waived, it is understood that the Tenant shall pay for a one-time cleaning fee that will be used to clean the property at the time of checkout. This cleaning fee is non-refundable and is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize and clean linens. Guest(s) are asked to follow all checkout procedures detailed in this agreement and/or posted in the guest welcome book at the home and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Glitter and confetti are not allowed at the property, inside or outside. Please do not use tape on any property surfaces. Undue and/or unreasonable cleaning of the home shall be the responsibility of the Tenant at a rate of $100/hour, with a one hour minimum. This also applies to the property exterior, grounds, and grills.
UPON ARRIVAL. Guests should carefully examine the lodge. If there are concerns or issues with your rental Vacation Property, please immediately contact us (please leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during, not after your stay.
TV & INTERNET SERVICES. RRL subscribes to satellite Internet services. The Internet access username and password are printed at the lodge for your convenience. RRL does not guarantee any programs, events or reception. Guest(s) are not permitted to order any pay-per-view events. If a guest does order pay-per-view, a $125.00 processing fee will be the responsibility of the tenant on top of the pay-per-view charges. Please do not unplug cords or devices on the televisions or Internet equipment.
LOST OR FORGOTTEN ITEMS. Please check carefully for belongings before you leave. Items left behind can be mailed to you if requested; you will be charged shipping costs. RRL is not responsible for lost or stolen items.
SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE LODGE! When you rent the Lodge, you assume responsibility for it and its contents, as well as your personal property. Please always lock the doors and windows when you leave the lodge. Children are welcome, but there are conditions in and around the home that may pose hazards to them, as well as to adults. RRL does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazards.
DAMAGES OR DESTRUCTION. It is understood and agreed by the Parties, the Tenant is responsible for all damages to the building and grounds and for any and all other violations of this Agreement.
INDEMNIFICATION & HOLD HARMLESS. While RRL LLC strives to maintain the lodge in the finest condition, no guarantees are expressed or implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the lodge structures and premises at their own risk. RRL shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances (including grills), furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. Guests are responsible for all damages. This includes loss of use for future reservations of the vacation rental property until necessary repairs are made. No guarantees are expressed or implied as to the suitability of utilities and other services provided to the RRL and adjacent structures and premises. No guarantees are expressed or implied regarding the suitability/compatibility of materials utilized in the construction of the lodge and/or its contents. RRL shall not be held liable or otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the lodge and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to, appliances, linens, carpeting, utensils, fixtures, and/or other equipment. By renting this home you agree to this agreement, Guest(s) and invitees hereby agree to forever hold harmless and indemnify Rifle River Lodge LLC from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the lodge. BY RENTING THIS LODGE ON THIS WEBSITE THE TENANT ACKNOWLEDGES AND ACCEPTS THE TERMS AND THE POLICIES INCORPORATED HEREIN.
